End User License Agreement
JoomlaKave / MetaKave provides computer software (digital copy), documentation (web based), and source code in this product (‘Licensed Software’) and licenses its use to the party (“You”) who purchases and uses this product, as follows:
You have the ‘transferable’ right to use as more copy, on as many domain of licensed software internally for Your own research and development or other business purposes. You may copy, transfer full or partial and distribute freely.
At JoomlaKave’s sole discretion, a portion of the this software may be provided in source code form, constituting proprietary information of JoomlaKave. If provided, You may use these sources to customize the software for Your particular needs, or simply as supplementary documentation.
RESTRICTIONS ON DISCLOSURE
You agree to use reasonable efforts, and to take the same precautions that You take to protect your own computer programs and other information of similar value that You do not wish to have disclosed or disseminated to others, to avoid disclosure or dissemination of any part of the Licensed Software, its documentation, or its source, to any third party by You and Your employees, agents or consultants (if any). These restrictions will not apply to any information that becomes publicly known, through no fault or breach on Your part, that Our software regularly provides third parties without restrictions on disclosure or that you receive from a third party rightfully and without restriction on disclosure.
You agree that MetaKave and JoomlaKave has and will retain all ownership rights in the Licensed Software and its documentation and all related patents, copyrights, trademarks, service marks, and other proprietary rights, and that You will have no interest in the Licensed Software and its documentation except the limited license provided under this Agreement.
NO OTHER LICENSE
No rights or licenses are granted by JoomlaKave/ MetaKave under this License, expressly or by implication, with respect to any proprietary information or patent, copyright, trade secret, or other intellectual property right owned or controlled by Our software, except as expressly provided in this License.
This License is effective until terminated. You may terminate this License at any time by destroying the Software, related documentation and all copies thereof. This License will terminate immediately without notice from JoomlaKave/ MetaKave if you fail to comply with any provision of this License. Upon termination You must destroy the Software, related documentation and all copies thereof which are in your possession or under your control.
DISCLAIMER OF WARRANTY ON SOFTWARE
You expressly acknowledge and agree that use of the Software is at your sole risk. The Software and related documentation are provided “AS IS” and without warranty of any kind and Our software expressly disclaims all warranties, express and implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. Our software does not warrant that the features contained in the software will meet Your requirements, or that the operation of the software will be uninterrupted or error-free, or that defects in the software will be corrected. The entire risk as to the results and performance of the software is assumed by You. Furthermore, Our software does not warrant or make any representations regarding the use or the results of the use of the Software or related documentation in terms of their correctness, accuracy, reliability, correctness, or otherwise. No oral or written information or advice given by Our software or Our software’s authorized representative shall create a warranty or in any way increase the scope of this warranty. Should the software prove defective, You (and not Our software or Our software’s authorized representative) assume the entire cost of all necessary servicing, repair or correction. Under no circumstances including negligence, shall JoomlaKave and or MetaKave, or its directors, officers, employees or agents, be liable to You for any incidental, indirect special or consequential damages (including damages for loss of business profits, business interruption, loss of business information, and the like) arising out of the use, misuse or inability to use the software or related documentation, breach or default including those arising from infringement or alleged infringement of any patent trademark, copyright or other intellectual property right by JoomlaKave and or MetaKave, even if JoomlaKave and or MetaKave or Our software’s authorized representative has been advised of the possibility of such damages. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to You. Our software will not be liable for 1) loss of, or damage to, Your records or data or 2) any damages claimed by You based on any third party claim. In no event shall JoomlaKave and MetaKave is total liability to You for all damages, losses, and causes of action (whether in contract, tort (including negligence) or otherwise) exceed the amount paid by You for the Software.
This License constitutes the entire agreement between the parties with respect to the use of the Software and the related documentation, and supersedes all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. No amendment to or modification of this License will be binding unless in writing and signed by a duly authorized representative of JoomlaKave and MetaKave .
All products (“software”) released by JoomlaKave is tested thoroughly on all the versions for the CMS they are intended for. On top of that we are also happy to provide additional technical support (“free support” for basic troubleshooting, and “paid on hourly basis” for extended / advanced support).
Unlike physical goods, electronically distributed software and software licenses can be easily duplicated. Once we have distributed a release version to the customer, the sale is final, and you may not return the software for a refund or credit without any valid reason. Please be cautious and make sure you know what you are purchasing.
In special cases due to inherent problem in client’s end such as a conflicting plugin / module, corrupted components of CMS, a Product may not work. In such cases, once after basic troubleshooting is done, we may refund 100% .
Finding a bug in our products is not a reason for a refund. If you do find bugs, please report them so that we can fix them. Use our contact page to any bug report, we will get back to you as soon as possible.
JoomlaKave reserves the right to approve refunds in the following cases ONLY:
- Product doesn’t work as it’s described and we failed to fix bug and don’t provide any support about your question that is relevant to our product (“software”)
- Product doesn’t have the features listed in the product description page.
- If you bought the product from JoomlaKave or it’s family web sites
- We provide 100% refund if you let us know withing 10 days after purchasing the extension, and if you deserve refund according to our refund policy.
- Provide all necessary information about your purchase like the first name, last name , paypal transaction id (email), transaction date etc.
The cases when you will not get full refund OR You will not be refunded:
- If you purchase any extension that has full features as mentioned in product description and live demo, And also If it does work in your site as same. But after a while you are wanting new feature, OR you change your mind, and tell us, "Sorry I need this feature, or I will not use your extension." "Get me this feature or Refund me". In this case we will not accept your request. You should watch the detail functionality before buying the extension. Or if you have query You can ask to support team/Live Chat before buying any extension. You may have extra demand, You can ask for custom development for that, You cannot ask free support for this or you cannot ask for refund. We provide free support only for bug fixing, Installation and Configuration problems etc.
- Our support Team members will appear you with respectable manner. We expect you also do so with our support team. if we find anything like - You have appeared with our team members with Rude manner/behavior without any particular reason, then your support will not be taken care and you will not be refunded, Or may be you will be refunded 50% of the amount.
- In the case of support, We do provide support to a large number of our clients. So our support team may take 2 to 5 days to perform action, Sometimes you may think its getting delayed, So you can request/ask for a quick support. But If you say within 2-3 days that "My support is not taken care, I did not get solution, I want refund", then you will not be refunded OR you will be 50% of the total amount. You have to give us room/time to take care of your support.
- Our extension might have bug or might not satisfy you, then we will provide you support. but still if we can't satisfy you then we will refund you. But If you intentionally put a negative review on JED before our support service is not finished, You will not be refunded until you withdraw that review.
- If our extension get broken or conflicted or does not work for any third party extensions or templates,
then we provide free support to fix it. but if we fail, we do not refund our customers.
- Finding a bug in our products is not a reason for a refund. in this case we will not refund, If you do find bugs, please report them so that we can fix them. Use our contact page to any bug report,
- We will provide Fee support, If we fail, then we will refund you.
- If our customer buy any extension by mistake, that is non-refundable. Customer should check carefully before purchasing. If customer needs information, he can knock us by email or live chat before purchasing.
- If your knock us after 10 days of purchasing extension, you will get free support but you will not get refund.
- No refund if your webhost/server does not meet the requirements of Joomla, PHP and MySQL Versions
